Release Waiver and Assumption of Risk Agreement

This agreement explains the risks involved in participating in league activities and confirms that players accept those risks and release the league from liability. By signing, participants acknowledge they understand the potential hazards and agree to take responsibility for their own safety while playing.

BMSPL Waiver and Release of Liability

I acknowledge that participation in the Barrhaven Mixed Slo-Pitch League (“BMSPL”) involves inherent risks, including but not limited to the risk of serious personal injury, property damage, illness, permanent disability, or death. These risks may arise from participation in softball activities including contact with bats, balls, equipment, playing surfaces, other participants, weather conditions, or other hazards associated with recreational sport.

By registering and participating in BMSPL activities, I confirm that:

Physical Fitness

I declare that I am physically fit and able to participate in softball activities and that I am voluntarily choosing to participate in BMSPL events. I accept full responsibility for determining whether I am physically capable of safely participating.

Assumption of Risk

I knowingly and voluntarily assume all risks associated with my participation in BMSPL activities, including risks that may arise from negligence, unsafe playing conditions, equipment failure, or the actions of other participants.

Inspection of Facilities and Equipment

I agree that it is my responsibility to inspect the playing field, equipment, and surrounding facilities prior to participation. If I believe any conditions to be unsafe, I will immediately notify a league official and will not participate until the concern is addressed.

My participation in any BMSPL activity constitutes my acceptance of the playing conditions and facilities.

Release of Liability

For myself and on behalf of my heirs, executors, administrators, successors, and assigns, I hereby release, waive, and discharge from any and all liability:

  • The Barrhaven Mixed Slo-Pitch League (BMSPL)
  • League commissioners, executives, and organizers
  • Umpires and officials
  • Sponsors and advertisers
  • Volunteers and league representatives
  • Other participants and teams
  • Property owners and operators of the facilities used by BMSPL, including municipal authorities
  • Any agents, employees, or representatives of the above parties

from any and all claims, demands, damages, losses, or causes of action arising out of or related to my participation in BMSPL activities.

Indemnification

I agree to indemnify and hold harmless the above listed parties from any claims, damages, liabilities, costs, or expenses arising from my actions, conduct, or participation in BMSPL activities.

Insurance Responsibility

I understand that BMSPL does not provide personal injury insurance coverage for players. I acknowledge that it is my responsibility to obtain any insurance coverage I deem necessary to protect myself and other participants in the event of injury.

Injury Reporting

In the event that I sustain a non-minor injury during league participation, I agree to follow the injury reporting procedures outlined on the BMSPL website. I will notify the league commissioners at bmspl@bmspl.com within 48 hours of the injury occurring.

Media Release

I acknowledge that BMSPL events may be photographed or recorded. I grant BMSPL and its representatives the irrevocable right to use my name, image, likeness, or voice in photographs, video recordings, or promotional materials related to the league, including use on the BMSPL website, social media, promotional materials, or league publications.

Compliance with Laws and Facility Rules

All players and teams are required to comply with applicable municipal by-laws and facility rules, including regulations related to alcohol, cannabis, smoking, and use of public facilities.

Alcohol and cannabis are not permitted on the playing fields or in dugouts. Players who appear intoxicated may be removed from participation. Violations may result in disciplinary action up to and including removal from the league and forfeiture of league fees.

Age Requirement

Participants must be 18 years of age or older to sign this waiver and participate in BMSPL activities. For safety reasons, individuals under 18 years of age may only participate if a waiver is signed by a parent or legal guardian.

Code of Conduct

BMSPL is committed to providing a recreational environment where all participants are treated fairly, respectfully, and with good sportsmanship.

All players registering in the Barrhaven Mixed Slo-Pitch League (BMSPL) agree to the terms of membership and agree to abide by the following Code of Conduct.

Players are expected to conduct themselves in a respectful and sportsmanlike manner at all times while participating in league activities.

Prohibited Conduct

No player shall:

Abuse or Harassment

  • Engage in any form of personal abuse, including verbal, physical, or emotional abuse toward other players, officials, spectators, sponsors, volunteers, or league personnel.
  • Engage in harassment or discrimination of any kind. This includes comments or conduct related to race, ethnicity, gender, sexual orientation, religion, age, disability, or any other personal characteristic.


Disrespect Toward Officials

  • Refuse to abide by an official’s decision.
  • Threaten, intimidate, or verbally abuse an official.
  • Lay a hand upon, push, shove, strike, or otherwise make physical contact with an official in a confrontational manner.
  • Kick dirt or throw objects toward an official while disputing a decision.


Aggressive or Unsportsmanlike Behavior

  • Make disparaging remarks or take aggressive actions toward players, officials, spectators, sponsors, volunteers, or league personnel.
  • Use profane, vulgar, obscene, or abusive language or gestures directed toward any participant or spectator.
  • Engage in intimidating or threatening behavior toward any participant or spectator.
  • Fight or attempt to fight another participant.


Dangerous or Reckless Conduct

  • Engage in reckless or dangerous play that may cause injury to another participant.
  • Throw bats, gloves, benches, or other equipment in a forceful or dangerous manner.


Property Damage

  • Damage or attempt to damage league equipment, park property, or the property of other participants.


Public Criticism of Officials

  • Publicly criticize or discuss officials’ decisions in a derogatory or abusive manner with players or spectators during league events.


Intoxication

  • Participate in a game while intoxicated or impaired by alcohol or any other substance.
  • Use intoxicating substances while actively participating in a game.

Any player appearing intoxicated may be removed from the game at the discretion of league officials.

Equipment Violations

  • Use any improper or unapproved equipment.


Cooperation with League Officials

  • Provide false or misleading information to BMSPL officials.
  • Refuse to cooperate with a legitimate request from a BMSPL official acting in the course of their duties.


Public or Online Conduct

  • Post abusive, defamatory, or threatening comments about BMSPL, its players, officials, sponsors, or volunteers on social media or other public platforms.


Spectator Responsibility

Teams are responsible for the conduct of their spectators. Spectators who engage in abusive, disruptive, or inappropriate behavior may be asked to leave the facility by league officials.

Disciplinary Authority

League officials or umpires may eject any player from a game for violations of this Code of Conduct.

Players who fail to adhere to the standards outlined in this Code of Conduct may, at the discretion of the BMSPL Commissioners, be subject to disciplinary action including:

  • Warning
  • Game ejection
  • Suspension
  • Removal from the league
  • Permanent dismissal from BMSPL

Any behavior deemed detrimental to BMSPL, its players, sponsors, volunteers, or the reputation of the league may also result in disciplinary action.

Players removed from the league for disciplinary reasons may forfeit all league fees at the discretion of the BMSPL Commissioners.
